Patrick Zelnik : La gestion collective n’est pas obligatoire

La gestion collective des droits pour le streaming et le téléchargement sur Internet est-elle vraiment inéluctable ?

Dans la table ronde sur le rôle du politique pour favoriser la diffusion des contenus sur internet que j’ai modérée le 26 janvier au Midem, Patrick Zelnik laissait entendre que si le marché numérique décollait cette année en France, la gestion collective obligatoire ne serait pas nécessairement instaurée.

Pour mémoire, le rapport remis par la mission Zelnik recommandait une gestion collective pour le streaming et le téléchargement et laissait un an aux ayants droit pour s’entendre sur ce point, faute de quoi l’Etat se chargerait de mettre tout le monde d’accord. Le Président Sarkozy lors de ses vœux à la culture, puis le ministre Frédéric Mitterrand lors de son allocution au Midem, ont tous deux affirmé leur volonté de voir un régime de gestion collective se mettre en place pour Internet, malgré l’opposition affichée des producteurs.

Il semblerait pourtant que si un certain nombre de déséquilibres, que nous avons décrits dans un post précédent - concernant l’accès au marché, la capacité des plateformes à marger suffisamment ou la répartition des revenus issus du numériques - étaient corrigés, et si le marché numérique en France décollait enfin comme il a pu le faire ailleurs, la gestion collective ne serait plus obligatoire.

Les producteurs le savent apparemment, après en avoir discuté avec Patrick Zelnik. D’où l’ambiance un peu surréaliste qui règne depuis l’officialisation de ce rapport, et en particulier au Midem, où les producteurs ont affiché une opposition ferme à cette proposition, sans toutefois sembler trop inquiets

S’il devait aboutir, le principe de gestion collective obligatoire des droits sur Internet constituerait pourtant une véritable révolution dans la manière de commercialiser la musique. Apparemment, les producteurs sont confiants qu’Emmanuel Hoog, nommé médiateur sur cette question par le gouvernement, saura les entendre. Il leur faudra sans doute montrer qu’eux aussi ont entendu le message, et qu’ils sont prêts à discuter avec les autres acteurs du secteur musical pour la mise en place de fondamentaux économiques plus sains sur Internet.
